The Deputy Leader of the Opposition, Ham Lini, observes that two thirds of Kilman's backers "have a huge cloud of uncertainty hanging over them" in the ongoing Bribery Case. As well as running away from the "burning issues left unattended," Lini says, Kilman "hands over the reins of responsibility to a leader like Moana Carcasses whose fate is now in the hands of the courts." Ham Lini also drew attention to Kilman collecting the UN award to Vanuatu concerning information and communications technology (ICT) when he has said his government intends to control social media in Vanuatu. 37,000 voters in Port Vila will be going to the polls on 15 October for the by-election as a result of the death of the much admired Edward Nipake Natapei. Ex-FOL voters will this time leave their ballot papers at the VIT Hospitality Training Centre, ex-FOL having greatly suffered with cyclone Pam. (Radio Vanuatu) Suspensions continue as the gap to the Port Vila election narrows ... Finance Minister Willie Jimmy has suspended the VNPF Board led by Simil Johnson over "irregularities in investment decisions." No reasons were able to be given in the report this morning. (Daily Post) Ours but to wonder why. The Northern Islands Stevedoring Company (NISCOL) has a new chairman, the Port Via businessman Jay Ngwele (of the Iauko Group). He was appointed by Internal Affairs Minister Nevu, replacing Alfred Maliu of Santo, to head the wharf management company owned by the northern provinces in the northern city. (Radio Vanuatu) Daily Post reports 264 sewing machines have been destroyed owing to their infringement of VIPO regulations. Again, ours but to wonder why - why a happier conclusion to their illegality could not have been arranged. And, oh, by the way ... Daily Post says PRG was "set up by the former Government under the same Prime Minister, Sato Kilman, to generate much needed revenue in collaboration with the Vanuatu Financial Services Commission, to help the Vanuatu Government fund its development projects." VT 1.6 billion was raised under the Capital Investment Immigration Programme (CIIP) until this was stopped by the Natuman Government. The programme is now the Vanuatu Economic Rehabilitation Programme (VERP) for which a Real Estate Option was signed into effect on 7 August by PM Kilman. The Secretary General of the Citizenship Commission says PRG acts as as the designated agent of the Vanuatu Citizenship Commission. Officials of PRG travel from Hong Kong to Vanuatu almost every month to provide over ten applications and on their most recent visit last week, they arrived with 14 applications for the Citizenship Commission," the Citizenship Secretary General told Daily Post in an exclusive interview. "The Prime Minister makes the recommendations to the Head of State who conveys honorary citizenship to the applicants," he added. Yesterday, however, in Daily Post, we had history being made with the first major moves towards re-unification by the Vanua'aku Pati (VP), National United Party (NUP), Graon mo Jastis Pati (GJP), a slab of RMC, Nagriamel, MPP, and the Hope Party. They are together endorsing the candidacy of Kenneth Natapei, son of the late and much respected Edward Nipake Natapei, for his father's Port Vila seat in the by-election in a fortnight. Pastor Alan Nafuki pointed out to the large Sunday gathering at the Saralana stage that the Presbyterian Church had played an important role in Independence and was mandated to take such a stand again at the very recent PCV General Assembly at Erakor. Pastors and elders must help to ensure unity is a key issue by the national elections in 2016. A motion of the Erakor General Assembly re-inforces this, said Nafuki. Cautions against money coming in from Hong Kong were given by former PM Joe Natuman and former Lands Minister Regenvanu, both of whom are known to be opposed to the Real Estate Option for Citizenship. Regenvanu spoke of many MPs being anxious only for money for their own pockets, as in the alleged bribery cases, and of this being a crucial time for Vanuatu because of money recently received from Hong Kong. "Independence gave us our land back and achieved a unity which we must cherish," said Natuman. We are in an El Nino southern oscillation period, as we are every decade or so, and after a devastating cyclone (Pam) and with Climate Change being on everyone's lips, well the messages about productivity need to keep going out, and VBTC makes sure of this. The Independent sees it as "Famine". And then we have to be told of the main exams for schools being in October or November. Yes. Then we have the campaigns beginning for the Parliamentary seat vacancy caused by the death of Edward Nipake Natapei. The candidates on the campaign trail are Geogio Calo (UMP), Nadia Kanegai (PPP), Altaoi Ishmael Kalsakau and Jocelyn Mete (Independents), along with Kenneth Natapei in an historical coming together of seven parties about which I will tell you more tomorrow. Kenneth is the 25 year old son of the former VP leader. The Pacifica Medical Association conference has brought some 300 doctors to Port Vila. Amongst interesting matters to be discussed after the official opening tomorrow - traditional medical practices here in Vanuatu. The cyclone Pam experience will also be relevant to discussions Daily Post reports. Post yesterday had the plantation of frustrated British millionaire investor Ronan Harvey being looked after by local cattle man Kuvu Noel. He said Harvey's problems stemmed from a mis-understanding with a group of Kole villagers. Post today has two coconut plantations on Tutuba badly damaged by fire - arson suspected. The really good news today is the launching of the Vanuatu Rural Electrification Project of New Zealand and the World Bank. Places where there is no electricity available on the national grid will be able to have access to solar power under a 'plug and play system'. The advantages to students, aid posts and community centres will be colossal. NZ High Commissioner Georgina Roberts spoke of the increased economic opportunities, employment and improved livelihoods the system will provide, when VREP was launched this week. (Daily Post) There is only progress news on this week's big one in advance of the bribery judgements. The lawyers for the MPs charged with bribery have a Constitutional case before the courts, with Justice Fatiaki required to make a pronouncement on whether the Bribery Case is an abuse of process. Justice Fatiaki's hearing sat yesterday. Await further information. And thus there is reporting in the papers today of investigations at Vanuatu Post and Airports Vanuatu. The Opposition says the leaders of the country are taking it back to the stone age era. The Opposition says breaking the law is the crux of the argument and the MPs currently in court must be prepared to accept whatever the Supreme Court decides. Cruise ships will be able to return to Luganville in November, it is hoped in Post today. That same paper has huge amounts raised with the post-Pam music festival for Malapoa and from Unelco for Fes'Nap this year. Post also carries a warning from Professor Sue Farran that not enough is being done to protect the rights of custom owners to their land. The United Front for Change will be launched at Saralana Stage tomorrow with Kenneth Natapei stepping forward for the Front and being supported by Vanua'aku Pati, NUP, MPP, RMC, Hope, and Graon mo Jastis Pati leaders. Coming together makes a whole lot more sense than starting investigations. In Post Acting Police Commissioner Vake Rakau makes it clear that this investigation, even though his son was actually terminated, is really about misappropriation and his office is working closely with Prosecutions to ensure the matter is brought before the courts. The United Front starts to show its face at 1 pm. Daily Post says today that several media outlets have reported the constitutional application, but the content is not available. The candidates in the Port Vila by-elecion are to be announced today. Campaigning can then immediately begin. This then ends two days before voting on 15 October. (Daily Post) There is reporting of water shortages from the Shepherds, Ambrym and Epi, Daily Post reports today. In the wake of cyclone Pam, which particularly affected these places, often damaging water storage facilities, the dry spell brought by El Nino is being felt by people all over Vanuatu. The big news today is the strike notice having been issued by the Vanuatu National Workers Union on behalf of 137 Airports Vanuatu Limited staff. They want their Chief Executive Officer, Jason Rakau, re-instated immediately. They regard the replacement of Rakau by another at the behest of the politically appointed Board of AVL, when that other is facing facing serious misconduct charges, as unacceptable. The other major item is the re-appointment of Dennis Nai as Ambassador Extraordinary and Plenipotentiary to the People's Republic of China. Yesterday's Daily Post had Watson Willie replacing Rakau as CEO from last Wednesday, as decided by a new Board led by businessman Alain Lew. A strike will seriously interfere with aviation in Vanuatu. Such action by government organisation workers has happened before when governments are seen to be simply hanging on, as presently with so many MPs facing criminal charges. VBTC News also saw the possibility of strike action within VBTC - the national broadcaster - itself. The reasons were not outlined. VBTC News has drawn attention to the Prime Minister speaking of the colonial legacy of the Condominium continuing to divide people until today. The division is seen in every aspect of society, and is a main cause of all divisions of people in Vanuatu, he said. The PM has headed off to the UN General Assembly in New York. (Post) A so-called National Validation Workshop will meet in two months to look at the National Sustainable Development Plans for 2016 - 2030. PMO consultant Henry Vira said this will enable the final comments of provincial stake-holders and technical people and finalize how government departments will organise the plans. (VBTC) And the Deputy Prime Minister, in a sudden political move, has announced the re-formation of the Vanuatu Cooperative Federation. (VBTC and Post today) Radio Vanuatu News yesterday drew attention to the need for a single structure to represent all business interests in Vanuatu. The General Manager of the Chamber of Commerce, Astrid Boulekone, made this clear at a National Trade Development Committee meeting recently. The Chamber should be nationally recognized as representing the private sector throughout the country Boulekone and meeting participants agreed. Santo land owners from the Mango area have used the namele leaf tabu to block work on the new Santo wharf because they are unhappy at the VT 500 per cubic metre rate offered. They say the provincial and national governments must review the rate being offered. (VBTC) The URA has announced a 14.74% reduction in the water price, to VT 50.54 a cubic metre in Daily Post today. And another croc has been spotted in the Alkita River at Sola, Vila Times reports this week, with photo. Vila Times also has suggestions that Opposition Leader Lini and former PM Natuman and former Speaker Boedoro will be suspended from Parliament in an extra-ordinary session next month by the government still hanging in there. The Radio Vanuatu audio quality of the PM's address in the matter was not particularly clear but the amount involved is said to be around VT 1.5 billion. Included is the amount necessary to begin work in replacing the Korman stadium which earlier governments have failed to maintain properly, as with Malapoa College. The new stadium will be needed in two years for the SP Mini-Games. The Governor of the Reserve Bank says that the old coinage will need to be exchanged for new money by February next year when the old legal tender will cease to be used. This follows complaints from certain sectors as regards the similarity in size and design of certain of the new coins to old ones of lesser value. (VBTC) The Lands Minister, Paul Telukluk, is calling for a review of the reformed land laws because no custom land owners have been registered yet under the new procedures even though they have been in effect for 17 months. The lead item in Daily Post today appears to be a press release from the Lands Ministry. It is headed Land Law Review. One wonders whether it is the new laws which (despite massive consultation at regional or district level) are at fault, or the practical aspects of implementing them. On-line business registration of companies will be possible under new laws for the purpose. Certain of the details are explained in today's Daily Post. Roy McDonald of the Vanuatu Financial Services Commission explains in today's paper that many companies will have to register again under the new legislation. The Saturday coastal clean-up is described by Post as being a great success. Many local businesses assisted in the efforts to get rid of much litter. Residents further inland continue to ask when the Environment Unit will insist on tarpaulins to cover waste-carrying trucks going to Etas. Westpac Manager Operations Risk and Compliance, Edwin Williamson, testified that the USD 500,000 which made its way to PITCO (Pacific International Trust Co) in Port Vila originated with Kelvin Fong in Hong Kong. It was valued at VT 48 million and out of it, VT 35 million went directly to the account of Moana Carcasses at ANZ Bank. Williamson said that Thomas Bayer of PITCO had signed an incomplete document in the matter but it had not been signed by Kelvin Fong, Vila Times reported. Manager Compliance at Westpac, Leinasei Kaloris, told the Court of the distribution of money from the VT 35 million in the Carcasses account to other MP's accounts. The Court also heard how Tony Nari MP dispersed funds to MPs Richard Mera, John Tesei and John Kaltaliu from a bus at the airport at the same time as demanding an advance of VT 30.000 for himself which was never repaid. Still on the Bribery Case, The Independent this weekend seems to be claiming that defendant MPs' Constitutional rights have been breached by the Ombudsman, Public Prosecutor and Supreme Court. Defendants have not been given any chance to explain themselves. Such a line is unlikely to take them very far when they have had a further fortnight on full pay to explain themselves yet not had anything to say. Daily Post today offers helpful summaries in the lamentable matter before the Supreme Court. In likely more usual political shenanigans, the AVL CEO has been terminated according to Daily Post today and Vanuatu Post's CEO suspended then re-instated. Vila Times this week informs of a threat to strike by personnel of the national broadcasting service. VBTC's insolvency has been in question for many years and remains thus whilst a commercial manager is sought. Work being undertaken by the Shanghai Construction Group has caused the cancellation of two cruise ship visits to Luganville in a week. Radio Vanuatu News reported at lunchtime today that the VT 1 million Parliamentary allocation allowance given to MPs is not enough to enable them to carry out the different projects they intend for their communities. The only witness for the defence, Robert Bohn of Epi, said one million vatu falls far short of the VT 50 million Solomon Islander MPs receive and VT 150 million PNG MPs receive. That said, VBTC News did not report that it is MPs themselves who, by their own decision, decide the level of their allocation on the floor of Parliament. Former USP lecturer Sue Farran puts a very relevant question to Digest readers today: "One wonders why those MPs who have pleaded guilty in the current bribery case have not immediately resigned their seats? Instead they appear to be continuing to enjoy the privileges of their posts. Is it because past experience in Vanuatu demonstrates that however guilty an MP or Minister is of illegal behaviour, as established through the courts or recorded in Ombudsman or other reports, their political careers will flourish?" Yesterday Justice Sey made it clear to the accused that there is still a case they have to answer, even though defence counsels tried to argue there is no case. Justice Sey said "Having listened to the submissions made by all counsels, I rule that the accused persons have a case to answer, [and] the submissions of 'no case' by all defence counsels are hereby rejected." Yesterday it was learned in court that the Department of Customs and Inland Revenue has no record of the names of the businesses lending money to the MPs and the name of Moana Carcasses was only registered for the years 1999 and 2000. "Green Confederation Party Development Fund" and "Moana Carcasses Kalosil" did not appear on their listing. Yesterday Internal Affairs Minister Nevu of the Iauko Group (Santo) yesterday confirmed that he received a loan for 1 million vatu from the Green Confederation Community Fund in the presence of MPs Carcasses, Pipite, Nari and Vohor. He stated that the loan agreement had no connection with a motion of no confidence in the Prime MInister, Joe Natuman. Nevu also stated that the million vatu he received did not come from the Green Confederation Community Fund Limited as provided for in the loan agreement, but from the personal account of Moana Carcasses. Whilst the loan agreement did not require Nevu to sign a motion of no confidence in Prime Minister Natuman, he did sign such a motion "a week or two after signing the loan document." All media are covering the revelations of the considerable volume of evidence coming to light in a case regarded by many voters in nakamal discussion or on public buses as a national disgrace. All media have also covered the arrival of the 160 cattle of a breeding herd at Lolowai. The intention is to repopulate plantations in Penama with cattle. Acting Penama Secretary General Augustine Garae expressed gratitude to the SG of Sanma, Sakaraea Daniel, on the hand over at Lolowai of the barge load of bovines. Lagoon residents at the western end of Second Lagoon, Port Vila (Emten), have complained concerning the massive destruction of the forest on the land known as "Connie's Art Blong Yumi" without any discussion with residents. Former Lands Minister Regenvanu is assisting the residents and media in the matter. Many loads of quarry material have been brought in as foundations for a massive project, as yet un-explained. (Daily Post) The film "Tanna" has been a major hit at the Venice film festival. Two awards were granted: the Audience award and the award for the Best Cinematographer. This latter is Bentley Dean, who, together with Martin Butler, co-director, has been responsible for acclaimed documentaries in Australia. The cast for "Tanna" was entirely local. Radio Vanuatu News reports this lunchtime that Justice Mary Sey took evidence from the Director of Lands, Jean-Marc Pierre, and one of his valuation officers, despite an objection from the lawyer for the head of PITCO (Thomas Bayer) and MP for Epi (Robert Bohn) saying there were no grounds for taking evidence of this kind at this time when it would be used at the case for complicity in bribery. Justice Sey refused the objection and the court learned that the small piece of land in question (9,000 square metres) had been given by Yannick Milne to his daughter Marie-Louise Milne, wife of the main suspect in the Bribery Case, Moana Carcasses. The land is that which PITCO's CEO Bayer had sought in covering the placement of VT 50 million to the credit of Moana Carcasses Kalosil. The smirk normally seen on the face of Moana Carcasses Kalosil during the Bribery Case hearings departed as he left the court room yesterday to discuss with his lawyer allegations that he, DPM Carcasses, had threatened a female witness, Sophie Mera, Daily Post reported this morning that the Police are investigating her complaint. Justice Sey pointed out the seriousness of the matter: "If I get another complaint like this I am going to revoke your bail conditions and you will be kept incarcerated until the case is completed," Post reported. Post covered three MPs refusing the loan offer yesterday in today's paper. Isaac Hamariliu, MP for Epi, associated with the then government in November last year, said that a loan offer of a million vatu initially had been made by Carcasses, which would have been followed by payments of VT 200,000 on a regular basis until VT 4 million had been issued. Hamariliu did not accept. Nor did MP Don Ken, when approached by MP Tony Nari, MP Hosea Nevu and Jay Ngwele. He understood the loan "up to VT 5 million" was to "make Mr Carcasses the next PM." MP James Bule likewise did not accept an offer made by Carcasses in November last year inside the ANZ Bank. Other Prosecutions witnesses, including civil servants, gave evidence and continue to do so this afternoon. There is some good news ... VNPF has acquired a 14.40% stake in UNELCO (Post today) ... and ... NUP President and interim Leader of the Opposition, Ham Lini, has told Daily Post that NUP and other parties of the Re-Unification Group will support the candidacy of Kenneth Natapei in next month's Port Vila by-election. This is, of course, the Bribery Case. Lum was then subjected to the MP Tony Nari blandishments, Nari having been in Santo to make a similar offer to MP Havo Moli. Moli was refusing the VT 1 million bait to sign the motion, but, according to Nari, said he would accept if Lum did. A third campaign had to be mounted to tackle Lum at home, and this brought all three MPs, Pipite, Nari and Telukluk, to his house. The Bribery Case courtroom also learned of MP Bob Loughman hearing discussions concerning the offers of a million vatu through telephone calls between MPs Tesei and Nari in a Council of Ministers meeting. Loughman was shown the amount of money later, at his Ministry, in an envelope. Loughman did not sign anything and advised the matter be taken to the Speaker. Prosecutions witness Samson Samsen admitted in court that agreement to sign a motion of no confidence was not required of him when a deal was struck with Carcasses for a loan of VT 1 million. He had gone to the Greens office to sign a loan agreement. Others present at the office, he understood (MPs Carcasses, Pipite, Willie Jimmy, Paul Telukluk, Tony Nari and Serge Vohor) were there for the same purpose. The above Bribery Case reports are from today's Daily Post. Defence cases will be heard next week. Today Post also has 6 candidates for the Port Vila by-election: Alatoi Ishmael Kalsakau (Independent), Nadia Kaneggai (PPP), Kenneth Natapei (VP), Allan Carlot (Natatok), Georgie Carlo (UMP) and Jocelyn Mete (Independent). All media have covered a vicious attack on the manager of the Central Market by a number of assailants. Thirty-five persons have been arrested in relation to the Tanna arson case at Tanna Lodge. (Daily Post) Eilon Mass, Israeli national, has been convicted of the rape charges against him and will be sentenced on 25 September. Nor, it seems, did Mr Fixit Nari himself, really. One witness said yesterday that Nari said he "could forget about refunding the money" if Carcasses became the next PM. (Post today) Fortunately the real (and substantive, not accused of bribery) Head of State has returned from Fiji, his deputy and stand-in still needing to face criminal charges in the Supreme Court. At Laucala Bay, now as USP Chancellor, Fr Baldwin Lonsdale conferred certificates, diplomas, degrees (masters and doctorate) on some 650 students. Daily Post carries a photo from this event today. Henceforth I will leave details of this case until we come to the judgements. There is good news available, and ni-Vanuatu are achieving in a variety of ways - and every day. But I will stay well away from the Bribery Case for a while now. However, today, Post's Thompson Marango reports: Witness admits gambling with VT 470,000 ... And the story will be seriously considered and evaluated by many in this country. Daily Post says, and henceforth I quote: In court yesterday afternoon when cross-examined by a defence counsel, that he gambled away VT 470,000 given to him as a loan by MP for Pentecost, Tony Nari, Mera said "I put it back at the same place it came from, at the casino," when asked what he did with the money". His answer resulted in laughter across the room (and Justice Sey having to call for order). Mera informed the court that in 2014 MP John Tesei approached him at the nakamal and told him to go with him in the car to the airport with Mr Kaltaliu. He conveyedd that they met Tony Nari at the airport ... he was informed by Tesei that they would take loans from an investor. MP Nari was inside a yellow bus which the three MPs went one by one inside to be given the loan. He admitted being given Vt 500,000 by Nari who then asked him for an advance of Vt 30,000 so he went out with Vt 470,000. No document of repayment was supplied at that time when he took the money which he told the court he has not yet repaid. He remembered signing two papers inside the bus at the airport then he later learnt during calling for Parliament that his name was also included in a motion of no confidence. When cross examined about the same inciden he said there was enough light to make out that the money was a pile of Vt10,000 notes which he took, believing that MP Nari was telling the truth that the loan is from an inverstor.. "You are happy to take a loan of Vt500,000 from some unknown investor?" a defence counsel ask Mera. His answer was that he trusted Nari. "You considered that the proper business-like behavious (being a businessman) to accept cash of Vt470,000 in a yellow bus at the airport in the dark and signed off some blannk paper?" According to Mera the answer was "no." He admitted that he did not go to the police to report that someone was trying to bribe him but he took it to the casino which was his first time to go there. But he denied when asked during cross examination is he had asked for the money himself foir his gambling. No charge was laid against him for taking the money. Another incident revealed by MP Mera happened on September 2014 when he claimed Moana Carcasses, Willie Jimmy, Paul Telukluk, Steven Kalakau, and another person he forgot were present. He claimed it was during that time that MP Carcasses told him to go to his office the next morning to get a loan of of Vt 1 million. "He told me that when he gets into power he will add another Vt 4 million and an additional Vt 200,000 to his salary and if we are patient with him for 5 years the load will be wiped out," he informed the court. To not act on the issue of West Papua would be considered a moral failure of our collective leadership in the Pacific. The call on leaders has gained momentum in light of the Pacific Islands Forum (PIF), with leaders expected to convene in Port Moresby this week, with West Papua being one of the top contentious priority areas on the leaders agenda. Solidarity movements in the Pacific have peacefully demonstrationed with a firm message to PIF to endorese a fact finding mission to West Papua to investigate the human rights violations, to support the call for a UN Special Envoy on West Papua and to assist in placing West Papua on the decolonisation list at the UN. Historically the Pacific Islands Forum leaders have demonstrated their moral and political leadership recognising the right to self determination struggles in our region, notably in relation to New Caledonia and in seeking just resolution for many other politically difficult issues in our region such as the radioactive contaminants in the Marshall Islands. Our leaders have facilitated these difficult political issues with integrity in Pacific solidarity with the struggles of our people. PNG Union for West Papua (PNGUWP) Chairman, Ken Mondiai during peacful march over the weekend in Port Moresby said the issue of self determination including that of West Papua had been brought up at numerous Pacific leaders forum over the years, but very little had been done to address the growing human rights violations what continue to flood the media. "The time is now and our current Pacific leaders must act on the issue drawing their strength from historical leadership to resolve this on going conflict in a just and peaceful manner. "PNG has an important role to play at this forum and as host and incoming chair of PIF, we call on the Prime Minister Peter O'Neill and his Pacific counterparts to act morally and consciously when deliberating on West Papua," stressed Mondiai, PNG parliamentarian on West Papua and Oro Governor, Gary Juffa shared similar sentiments saying world leaders including our Pacific leaders have failed West Papua and continue to do so. Governor Juffa labled the United Nations as a failed organisation saying, "the UN has done nothing to address its apathy in 1969 when it supervised and watched with disinterest the Act of No Choice in West Papua when 1024 elders were forced at gunpoint to vote under duress to be part of INDONESIA on behalf of the entire people of West Papua , yet the UN preaches about the rights, violence, and torture in other parts of the world." "We are not free in the Pacific until West Papua is free...the challenge is on our leaders to act on West Papua this week and we expect some firm outcomes." "Songavare was vocal during the Melanesian Spearhead Group (MSG) leaders meeting this year in Honiara and we expect him to do the same at this year's PIF. The people of the Solomon Islands will continue to stand with our Pacific brothers and sisters in West Papua." Meanwhile, regional youth movement for West Papua, Youngsolarans have taken a strong social media drive with demonstrations outside. "We stand in solidarity with other regional movements are call on our leaders to endorse an independent fact finding mission to West Papua...we also want the leaders call on the UN to appoint a human rights special envoy to West Papua," said Youngsolwarans Fiji spokesperson, Vuetasau Buatoka. Mr Buatoka said there are talks of intense pressure from Indonesia on Fiji and PNG, "and we hope that our Pacific leaders are not influenced in their own forum space to negate their moral responsibility to West Papuans." Jimmy, however, chose to stay on as an observer. He is "no longer part of the case" following his decision to appeal "guilty" to his two charges, Radio Vanuatu News said at lunchtime today. He pleaded guilty to counts 52 and 53 alleging he received a million vatu from Acting PM Carcasses, one who is not registered as a legitimate and acceptable loan giver. Jimmy's new lawyer, Ronald Warsal, was in court today, having accepted to take on Jimmy as a client along with those who have received indemnification. Justice Sey thanked Jimmy who has agreed to assist the court. He would be given a reduction in sentencing as a result after the trial. The case continued this afternoon. The Opposition has called on Prime Minister Sato Kilman to cut short his overseas trips, Radio Vanuatu News reports at lunchtime today. Former PM Natuman told a press conference the country is presently in a very risky situation but the Prime minister seems un-concerned. Natuman said that the trips may be good, but with the allegations against so many of Kilman's cabinet colleagues, he must come back immediately to the country. Daily Post this morning was stronger, seeing the necessity of a motion of no confidence. The press conference was led by Opposition Leader Lini and former PM Natuman who said they had already advised the Government there was no alternative in this national political crisis. They pointed out that 16 MPs facing bribery charges were giving Vanuatu a very bad image regionally and internationally. Daily Post reported PM Kilman very impressed with China's victory day parade to mark the 70th anniversary of China's victory over Japan at the end of World War Two. Daily Post readers were also this morning advised through the AB's Regional Director Dr Andrea Iffland of the importance of annual maintenance of infrastructure. This was at the launching of the Vanuatu Infrastructure Strategic Investment Plan, and extremely worthwhile project containing 26 high priority projects worth VT 38 billion. Maintenance will cost a further VT 1.8 billion. But all credit must be accorded to Port Vila MP and Finance Minister Willie Jimmy for entering an early guilty plea yesterday, which no doubt will count for much in his favour in the final analysis. It is a smart decision on his part, although this must have been a shock to the other 16 defendants. Trial is now set for Monday 7 September. On Thursday last week, Vanuatu Supreme Court judge Mary Sey made a landmark ruling that all 16 parliamentarians facing corruption charges would stand trial both under the Penal Code and the Leadership Code Act. No public figure in Vanuatu has ever been tried under the Leadership Code Act since its enactment in 1998. Last week’s ruling means an eventual outcome against the accused MPs could prove damaging as far as the leaders’ political careers are concerned; and catastrophic, as far as the life of the present government goes. At least five of the accused are cabinet ministers: Deputy Prime Minister Moana Carcasses Kalosil, Finance Minister Willie Jimmy, Public Utilities Minister Tony Nari, Foreign Affairs Minister Serge Vohor, and Lands Minister Paul Telukluk. Among them are the Speaker of Parliament, Marcellino Pipite and Parliamentary Secretaries Silas Yatan and Steven Kalsakau. Starting next week, Justice Sey will preside over arguably the biggest corruption case ever in Vanuatu. The case concerns 16 parliamentarians – all from the government side – a prominent businessman, eight defence lawyers, and 48 prosecution witnesses. In 35 years of Vanuatu’s political history, only Ati George Sokomanu, the country’s first president, felt obligated to step down from his leadership duties, when he was reprimanded for a simple road traffic offence some 27 years or so ago. Apart from that, no one else has done it, regardless of allegations levelled against them. The public in Port Vila are eagerly waiting to see the outcome of the current case, which seems bound to open a new chapter in the country’s political history. Despite the seriousness of the matter at hand, Vanuatu’s Prime Minister Kilman appears unflinching, nor does he appear to be making any moves to consider the alternatives, among them the opposition’s suggestion that his government voluntarily step aside. Chances were slim from the beginning that Mr Kilman would consider this option. Cultural norms and history suggest that he may not contemplate resigning for fear of losing face and of the political backlash, especially when elections are less than 18 months or so away. Obviously he would want to continue leading as prime minister into next year’s polls. A second option is for Mr Kilman to terminate some or all of his colleagues and then seek to make amends with the Opposition by bringing them into Government. Many political hopefuls for the 2016 election fear this option because they are not prepared to be on the campaign trails too soon. For Mr Kilman, the second option seems to make more sense. Not only would he gain politically by keeping his position as prime minister, but he could also save himself from being accused of watching his own government fall from grace. In any case, he certainly has some tough calls to make as events unfold. With the trial commencing next week, at the very least three likely scenarios may also unfold. Firstly, as anticipated, the government, through Electoral Commission has set October 15th as the date for Port Vila to find a replacement for former Prime Minister and Vanua’aku Pati leader, Edward Nipake Natapei who died suddenly last month. But it is also possible that more than just the one seat left vacant by the late leader could be up for grabs, which then throws up further questions over the announcement by the Electoral Commission. Could they have waited a little longer, while monitoring the progress of current events in court? Chances are that at the stroke of Justice Sey’s pen, a completely new scenario might also unfold and authorities would then need to revisit the decision whether or not it makes more sense to conduct separate by-elections, or even declare a snap election, in the event of a dissolution of parliament. However, even for dissolution to take place, Constitutional provisions require that the president make this call, in ‘consultation’ with the office of the prime minister. In such a scenario, a different issue also arises: in the event of the coalition not being able to hold water, could the prime minister still function in the interim and work with the president on dissolving parliament? In 1989, during the tumultuous years when the Vanua’aku Pati was beginning to disintegrate, this was exactly the point of the government then led by Fr. Walter Lini, during the infamous sedition case involving Barak Sope and Sokomanu as the former president. Sokomanu had unilaterally decided to dissolve parliament for which Fr. Lini took him to task before Solomon Islands Chief Justice Gordon Ward — flown in as a neutral person to help out in the crisis. Rimbink Pato Esteemed members of the press from across the Pacific Members of PINA Colleagues and friends 1. Good morning. Welcome to Papua New Guinea and welcome to this two day media workshop. Your presence here is appreciated and extremely important. 2. This will be an important Forum Leaders Meeting for many reasons, first and foremost because Leaders will be considering a range of high priority and perhaps politically contentious issues for our region. However, these issues have come about through new and inclusive process of regional priority setting. The intention is that these issues could have game-changing and far reaching consequences for our region. [Role of the media] 3. You play an important role in informing the public. For that reason, it is important that media is independent and is able to convey issues and facts accurately. You must communicate in a way that provokes conversation and discourse on important issues for our region such that we have a well informed public that engages with the important regional issues. [Regionalism] 4. Since becoming Secretary-General of the Pacific Islands Forum Secretariat, I have prioritised the Framework for Pacific Regionalism. This Framework is as much about a process for identifying regional priorities, as it is about regional principles and ideals. It is about choosing to work together to address our shared challenges, and to strive towards the region that we want; in line with our culture, our values, and our principles. 5. But working together requires frank and potentially difficult discussions to be had by our Leaders. Regionalism has implications for sovereignty. Regionalism has implications for resourcing. Regionalism requires respect for shared standards and values. These are difficult conversations but they need to take place. 6. They need to take place not simply in the political arena. It is important these discussions also take place in the public domain – particularly if we are to achieve the deeper regionalism that the Framework encourages us to consider. Needless to say, the media has a big part to play in raising the level of these discussions in the public domain. [Framework Process] 7. Five key issues have been identified – through a public process – for Forum Leaders to discuss next week. Let’s stop to consider this for a moment. For the first time, issues to be discussed at the Leaders level – priority issues – have been determined by members of the public. Two were based on submissions from regional or sub-regional organisations. Three were based on submissions from civil society organisations. Again, I think we should recognise the importance of this. Regional initiatives will be discussed at the highest levels and they were generated by the public through the framework. 8. These five issues were selected by the Specialist Sub-Committee on Regionalism, an independent and representative body, whose role was to consider all 68 regional initiatives that were submitted. The Sub-Committee applied a range of tests that are set out in the Framework and my colleagues will be able to speak in more detail about this process throughout the course of the workshop. 9. A fundamental dimension to the Framework for Pacific Regionalism is the shift in the development paradigm that it calls for. When I returned to the Pacific having spent many years working around the world, I returned to a region highly dependent on development assistance. With this assistance, and particularly the extent of this assistance, I also see an inability of our own people and our own Leaders to articulate and prosecute their own development and political agenda in the region. The Framework calls for us to turn this state of affairs around – to ensure that our Leaders are setting the regional agenda, based on a public process for identifying key issues. I’m sure you would agree with me in saying that this represents a major shift in how things are currently done in this region. [Regional priorities] 10. Let me now turn to speak briefly on the five priority issues that Leaders will discuss. 11. The first issue is increased returns on fisheries. Maximising revenue from our fisheries is of course a potential game-changer. The estimated value of the catch per year being around 3-4 billion US dollars, but much of this catch is processed outside of our region. The essence of this initiative is that Leaders agree to restructuring the tuna industry and phase out foreign fishing vessels over twenty years. The other aspect to this initiative is that Leaders task Fisheries, Economic and Foreign Ministers to undertake a joint comprehensive evaluation of the regional monitoring, surveillance and compliance regime. 12. The issue around climate change contains two elements. The first is that Leaders agree on a high level, political statement on climate change to take to COP 21 in Paris later this year. The second component is that Leaders endorse a draft strategy on Climate and Disaster Resilient Development in the Pacific. 13. A response to alleged human rights issues within West Papua will also be put to Leaders for consideration. Three submissions, representing over 30 civil society organisations across the Pacific were put forward. In terms of the correct nomenclature, it is important to point out that West Papua is the language used by those who made the submissions on this issue. Needless to say, this is likely to be one of the more contentious issues on the agenda. 14. Leaders will also consider cervical cancer. This week the PNG Medical symposium has been taking place here in Port Moresby. My friend Dr Glen Mola tells me that a priority conversation across the week has been the need for an effective national screening and HPV vaccination program to treat cervical cancer in PNG. Research indicates that this is not a unique situation. Women and their families across the region are experiencing pain and suffering at the hands of an illness that could be prevented. There have already been positive outcomes in addressing cervical cancer in Fiji, and there are lessons here that can be applied in other countries in the Pacific. 15. The last issue to be put to Leaders is Information and Communications Technology (ICT). Like the return on fisheries, ICT has the potential to transform our region. We already see the profound effects that mobile phones have had in the Pacific. There are educational, economic, health, disaster management, as well as communications benefits that can be realised if the proper ICT infrastructure is put in place. [Forum Leaders Program] 16. There are of course a number of other important meetings to take place next week. Let me quickly brief you on the key meetings and what is to take place in each of these. 17. On Sunday and Monday, a Civil Society Organisation Regional Forum will be held, coordinated by the Forum Secretariat. There will be about 50 participants in attendance, who will discuss the regional priorities that are going Leaders. Tuesday they will present their considerations directly to the forum Troika. 18. On Monday, the Smaller Island States Leaders will convene to discuss issues the five priority issues with particular reference to the implications that they have for Smaller Island States. 19. The Pacific ACP grouping will meet on Tuesday. The meeting will be dedicated to reviewing ways to strengthen the PACP engagement for better development outcomes in the Pacific region. 20. On Wednesday the Pacific Islands Forum formal session will begin; this is an opportunity for Leaders with forum associate members and observers to discuss major issues. The day will also include a high level climate change brief for Leaders, to be coordinated by SPREP and SPC. 21. The Leaders Retreat on Thursday is essentially where they will discuss the five regional issues that have come through the Framework. In addition to a number of standing issues on the Forum agenda, such as RAMSI, the Leaders gender equality declaration, a strengthening of the Post-Forum Dialogue, the Post 2015 development agenda, as well as the Forum Compact. 22. On Friday, Leaders will sit down with Post-Forum dialogue partners to ensure that PFD partners support the regional priority issues endorsed by Leaders at their retreat. [Concluding Remarks] 23. So to return to my earlier sentiments, let me reiterate the significance of the Framework for Pacific Regionalism both within the Secretariat, and also at the Forum Leaders meeting next week. 24. Let me also reiterate the importance that you will play in covering the events over the coming days; I do hope that your work reaches our Pacific people, and the result is greater discourse and dialogue. 25. To West Papua, ULMWP and all the Melanesian and Pacific family, Papua New Guinea (PNG) has rejected my application for a visa to enter the country for the second time. I am disappointed that PNG as a democratic country which values democracy, freedom and justice has come to this decision. The first, I was informed that the issue was an administrative matter and the reason given was that I did not complete the necessary PNG immigration documents and procedures. As per an invite (attached) by the Governor of the National Capital District (NCD), Hon. Powes Parkop to attend a human rights refugee conference, and also take part in other events including PNG’s 40th independence celebrations, and the Pacific Island Forum in my capacity as the spokesperson for the United Liberation Movement for West Papua (ULMWP); I launched a full visa application which was checked by my lawyer and I preceded with flight bookings. A few hours before I was due to board my flight from London Heathrow to Port Moresby this week, I found out that the PNG immigration rejected my visa application, and as a result, I have cancelled this trip to PNG. There were no proper details or formal explanation from the PNG High Commission in London as to why my visa application was rejected. I respect the decision by PNG Government and its immigration department, but I hereby appeal to the Government to not penalise the struggle of the people of West Papua. I strongly urge Prime Minister, Peter O’Neill and all Pacific leaders to stand firm as Pacific leaders and support the issue of West Papua at the leaders meeting next week. West Papua is one of five top priority areas on the Pacific Island leaders Forum agenda, and I appeal to the people of PNG and the Pacific to rally your support on the recommendations set before the leaders. We the ULMWP are calling on our Pacific leaders to form a high level PIF delegation to undertake a fact finding mission to investigate the human rights abuses in West Papua; and to strongly urge the United Nation to appoint a special envoy on human rights to West Papua. There is growing support in the Pacific, and I want to personally thank my Pacific brothers and sisters who are always supportive of our freedom journey. Please continue to support the people of West Papua in our struggle for freedom. Eighteen members of Parliament on the Opposition side have agreed and they are trying to find support from Government MPs. The main reason is the bribery case in which allegations have been raised against 16 MPs amongst whom 5 are state ministers. This, they say, is giving Vanuatu a bad name both regionally and in the world. A total of 37 signatures will be needed. Prime Minister Kilman is in China for the 70th anniversary of the Chinese victory over Japan at the end of the Second World War. The PMO has made no statement concerning the many allegations against those of cabinet rank within his Government, including the Acting Prime Minister and Acting Head of State. Nor has there been any official reaction to the Finance Minister's plea of "Guilty" in the Bribery Case. Further to what the Digest has already reported, the Acting Head of State Marcellino Pipite, following his visit to New York to meet ambassadors from countries adopting the Westminster system, Speaker Pipite observed that Vanuatu has shifted away from the Westminster system. This has meant "too many cases that have seen MPs and political parties seeking court decisions." Pipite adds "It is my intention to invite members of the Westminster System, preferably from the United Kingdom, to come to Vanuatu and provide insight to MPs on the procedures, and how the system operates, in order to bring Vanuatu back on track of the system we inherited in 1980." (Daily Post, 2 September) Wednesday's Post has the Reunification Group (VP, NUP, MPP and Nagriamel) all in agreement to support the VP candidate in the election in October to replace the late Edward Natapei, former Leader of the Opposition. Graon mo Jastis Pati leader Ralph Regenvanu was present as present Leader of the Opposition, Ham Lini, made the announcement. MP Lini also suggested that if a consensus could be reached, the Reunification Group would like to see the VP candidate (Kenneth Natapei) elected unopposed, saving the Government considerable money. Daily Post this week also reported a horrendous traffic accident in which three Onesua students had to be hospitalised in Vila after their drunken driver crashed their vehicle near the Siviri field. They were travelling on the open flatbed of the truck and bags of cement landed on top of them. Today's Daily Post has water costs being reduced by 6% as of today. Just a few further aspects to the Bribery Case ... Justice Mary Sey is allowing no further appeals concerning her rulings in the matter so far, seeing these as simply being delaying tactics. Further appeals must now await judgements in the matter. Processes of her court must not be appealed until the cases are decided. From Monday the cases proceed in three steps, beginning with the most serious. The current Acting Prime Minister faces the majority of the charges in the Bribery Case. DPM Carcasses is the recipient of 24 counts. However it was not stated where Prime Minister Kilman happens to be at this time. Your news Digest has failed to establish whether the Government has issued any press release in the matter of the Bribery Case. The dispiriting affair is the subject of an excellent Opinion piece in today's Daily Post in which Kierry Manassah points out that some 25 years ago former President Sokomanu felt obliged to stand down after a simple road offence. Marcellino Pipite is the Acting President since, as Speaker of Parliament, he took over the function of President Baldwin Lonsdale yesterday whilst the latter is in Fiji for USP purposes. Of course everyone is innocent until proven guilty. And Pipite did see a need to revisit the Westminster system following his visit to New York ended early this week. However, it has to be added that Finance Minister Willie Jimmy Tapangararua did plead guilty in the Bribery Case this morning in the absence of the person he has chosen as his counsel. This was not made clear in the earlier Digest blog today. The Bribery Case, having taken the full morning, is now adjourned until Monday morning. Some 56 charges were heard, the vast majority against MP Moana Carcasses Kalosil. Almost all charges were answered by the accused in this morning's plea-taking as "not guilty". It seems, however, that Finance Minister Willie Jimmy Tapangararua, who was present, was not represented by Robin Tom Kapapa as accepted last week, and his chosen new counsel was not present. Almost all are accused of accepting illegal loans under the penal and leadership codes. Thomas Bayer's charge of complicity in bribery was detailed as the procuration of half a million US dollars through offers and sales of shares in his off-shore bank, European Bank Limited, and shares in a lease title which was detailed. Documents supplied by Bayer were alleged to be sufficient to enable the European Bank to receive the money from the United States to then be transferred to an account of Moana Carcasses Kalosil to enable the large number of public officials to be bribed. Bayer's plea was "not guilty". Many of the accused are of the rank of minister in the present government.
