The Chief Justice saw 2015 as "important for the law and the Courts in this Republic." He invited his hearers to reflect on the impact of the law on the community, and on the roles of the Judiciary and the legal profession within it. He said "Vanuatu society puts important value on the concept of the rule of law as a cornerstone or pillar in our community. It is important to understand Vanuatu's legal system and how justice is administered. I say that because, conceptually, this is after all the purpose of the law. Vanuatu's legal system is mainly based on the common law, some aspects of French law and judicially-declared custom law. Fairness, transparency and access to justice are also fundamental characteristics of Vanuatu's legal system. The law is there to facilitate the well-being of the people of Vanuatu and society. The video claims to be promoting Vanuatu's national beer the 100% New Caledonian-owned beer brand Tusker, but it is more like a Port Vila bus driver's fantasy brought to life: an attractive, skimpily-dressed foreign-seeming woman hails down a bus for a joyride around Efate — as the lone passenger, until, after a weird montage of spinning wheels and cigarette (?) smoking, she is joined by some random but conveniently picturesque young people and a conveniently picturesque, très authentique ukulele-playing uncle. Good times. They say there's no such thing as bad publicity, but we're not convinced that's entirely true – what do you think? Funds are immediately avail" Respond to this post by replying above this line New post on Vanuatu Daily Digest Virgin Australia pulls out; NBV offers interest free loan to assist runway repair by bobmakin The news is full of the Virgin Australia pull-out today, especially concentrating on a National Bank of Vanuatu offer to assist with financing re-surfacing Bauerfield Airport up to $1 million. It would be an interest free loan. Funds are immediately available. The failure of airport services gets comment from someone listening to the control tower radio this week, when clearance to take-off was requested by the Virgin pilot. No-one from the tower gave any answer. The caretaker PM weighs in to the arguments about funding work at Bauerfield – but before the NBV offer was publicised. He complains of Daily Post reporting misguided editorial opinions from politically-biased newspapers. He concludes "The Daily Post should stop trying to play politics and leave it to the politicians." He does, however, agree "the airport runway is an important, urgent and serious technical matter." Air New Zealand, Virgin Australia and the travelling public can all agree on this and filling the potholes is probably not something we should have left to the politicians. The Judicial Year opened this morning with the presence of the Head of State, Chief Justice and all concerned with the administration of justice in Vanuatu. Photo: Wikimedia Commons In a further blow to Vanuatu's air travellers and battered tourism industry, Virgin Australia has just announced that its Port Vila service has been suspended until further notice, after representatives from the airline inspected the deteriorating condition of the Bauerfield runway over the weekend. Customers who are booked to travel to or from Vanuatu will be provided with either a refund, change of destination or travel credit, says the airline. Virgin Australia is the third airline to suspend their Port Vila service, following similar announcements last week from Air New Zealand and Qantas. Earlier this week, Vanuatu's Civil Aviation Authority directed Airports Vanuatu Limited, the operators of Port Vila's Bauerfield International Airport, to upgrade the runway. Our newly elected representatives must only choose leaders from those amongst them who can explain the plight of the country which has seen airlines refusing to send their planes here because of the state of the international airport's main runway. This crisis has emerged since the Caretaker Prime Minister assured us in pre-election campaigning on 15 January that Vanuatu is ending the financial year with the biggest fiscal surplus ever recorded in Vanuatu history. This occurred despite cyclone Pam and the much publicised Capital Immigration and Investment Plan - CIIP which Kilman said "failed miserably to meet its legal requirements contained under the signed agreement." Government has now committed VT 3 million to make good our debt to the United Nations which left us without the right to vote on matters of particular interest such as West Papua. VT 2 million was paid in May, Daily Post reports and the latest payment should cover arrears of USD30,399. Yesterday I mentioned the 2011 efforts and the granting of Australian aid for the purpose arranged by the DG of MIPU. But of course in March last year when the Ausaid offer had lapsed because politicians kept changing the requirements, the World Bank was brought in. All ministries were in agreement, for the Vanuatu Aviation Investment Programme to be funded by the World Bank. $60 million of funding was secured. However, the Natuman Government, which had come to power with 33 votes of the 52 members, was thrown aside by the Kilman Government which then, in the midst of the bribery scandal, had decided that a Chinese contractor should undertake the work and it would be funded by the Chinese EXIM Bank. The debt was massively doubled by the Kilman Government decision. Thus do politicians look to interests other than the national ones and make problems for later governments. Daily Post highlights the complete airport rehabilitation story of failure today. Daily Post and Radio Vanuatu both extensively cover the outgoing caretaker government's launch of what is claimed to be the "first ever" livestock policy. Present Caretaker Minister Emelee recognized the efforts of his predecessor, David Tosul, in getting the policy going and expressed his confidence in the plan, so it does not seem to be a campaign strategy for the government we are to see next week. Livestock is important to the economy and could raise more export earnings. The official counting by the Electoral Office personnel is well underway, but the task is daunting — a long one: every ballot paper will be re-counted and checked. Ballot boxes and reports are being collected from remote polling stations by the Solomon Islands patrol vessel. Others are being carried to the capital by plane. Port Vila's Mayor Ulrich Sumptoh has been re-elected mayor of the capital by the council. He left the mayoral office to stand as a candidate in the national election but accepts that he failed to win the number of votes to secure a parliamentary seat. Yesterday's Daily Post carried the headline AVL directed to act on required measures to ensure jet operations continue at Bauerfield. It is the Director of the Civil Aviation Authority, Joseph Niel, who is doing the directing. Photo: Wikimedia Commons The World Health Organisation in Vanuatu is warning of the possibility of an outbreak of the mosquito-borne Zika virus. There were some cases here two years ago, Dr Jacob Kool of the WHO reminded readers of The Independent at the weekend. Mild fever, rashes, red eyes and conjunctivitis, muscular pain and headaches are symptoms. They are similar to the symptoms of dengue, and are spread by the same type of mosquito (Aedes aegypti). However, the disease has broken out in South America and babies born of mothers suffering from it can suffer from microcephaly, or abnormally small head size. Any dengue-type symptoms should be reported to clinical services. Qantas has also followed suit, suspending their codeshare arrangement with Air Vanuatu this afternoon. Both airlines will despatch safety experts over the weekend to assess the state of the runway. Yumi Winim Fridom is a 1981 documentary that follows the people of the New Hebrides as they struggle to win freedom from their colonizers, France and Great Britain, the attempts at secession by various groups in 1980 and finally the birth of Vanuatu on 20 July 1980. Polls opened at 7:30 and by midday there had been no suggestion of any disturbance anywhere. Members of the various observer teams have been posted to polling stations which all have groups of young party faithful standing by to make sure the act of free choice takes place as prescribed. Vanuatu has no history of voting day electoral violence and in any case police and members of the Vanuatu Mobile Force are on hand to prevent any unfortunate incidents. First unofficial results are expected during the evening. The suspect remanded following the death of Vanuatu boxing's "Golden Boy", Philip Kating, has himself died whilst in custody. Police are investigating but there is no further news at this stage. Thew 2017 SP Mini Games CEO, Joe Carlo, has said that information attributed to him concerning a delay in the date for the Games is not true. Photo credit: Transparency Vanuatu With 14 MPs from the just disbanded Parliament in prison, and just 20 hours left before Vanuatu voters choose those who will form a new one, Transparency Vanuatu is calling on voters to ensure MP integrity and support for the rule of law. Transparency sees a need for substantial reforms in the political system to make Parliamentarians more representative and responsible to the citizens of this country. Regulation of political parties through new legislation to control political finances, accurate updating of the electoral roll and putting the voting system beyond abuse are seen as essential. But TIV’s Dr Willie Tokon adds revision of the parliamentary standing orders, regulations concerning MP allocations, and rules about no-confidence motions must also be considered essential. Last, but not least, TIV’s Chairman insists the Right to Information Bill gets enacted and the Ombudsman Act and Leadership Code are expanded. The large number of election observers reflects the widely held view that we have left many of the items on the TIV “to do” list for rather too long a time. Election observers represent the Commonwealth, Forum Secretariat, MSG, EU, Australia, New Zealand, China the UK and USA, Daily Post points out this morning. The Dept. of Internal Affairs’ Cherol Ala yesterday told of the immense task in organizing the snap election in such a very short time. There was the added difficulty of the Principal Electoral Officer being taken seriously unwell in the midst of the huge preparations. However, apart from the difficulties perceived on Tanna the electoral process has run smoothly over very long days. Heather Lini-Leo. Photo: British Friends of Vanuatu Heather Lini-Leo Matas died at the weekend. She was Vanuatu’s first indigenous female lawyer. Wife of Ombudsman Kalkot Mataskelekele, Heather (sister of the first PM Walter Lini and eighth of ten Lini children from North Pentecost) was most recently serving as the principal legal officer in the National Provident Fund (VNPF). She had held a wide variety of senior legal positions in government. She studied law in PNG, Australia and the United Kingdom. A funeral service is planned for Wednesday morning at 7 at the Anglican Church, Tagabe, and the body will be flown to Pentecost for burial. Philip Kating. Photo: boxrec.com Vanuatu’s first professional boxer, Philip Kating, passed away midday Sunday after an injury caused by another person. Kating, now believed to be in his sixties, held a number of Pacific titles and turned professional in Fiji in 1980. He won the only gold medal for the New Hebrides — as we still were — in the Guam South Pacific Games in 1975, earning himself the title of Golden Boy. Anglican missionary teacher Mavis Salt passed away earlier this month in the United Kingdom. She was the last of a long line of such professionals from the times when the mission was based on Norfolk Island. Mavis Salt’s last position was as principal of the Torgil Training Centre for girls at Lolowai, Ambae, from 1955 to 1976. Indeed her house at Lolowai had originally been used by the Mission on Norfolk Island and later accompanied the Mission to Mota before coming to rest on Ambae. A number of women in Port Vila still remember Mavis as “my teacher”, the dedicated trainer ensuring those who could benefit from more extensive training in education continued at the Kawenu Teachers’ Training College in Vila. Mavis Salt will be cremated at Yeovil in the UK on 22 January. A memorial service has already been held. All electoral campaigns for the 2016 snap election close tomorrow. Having previously established a legal framework for land law reform (the ‘G’ of GJP) now the Party is looking to the big J – justice. The GJP website says the party wants the justice system seriously enforced to bring the country to a state of good governance and transparency which will see a massive cutting down of the festering corruption. GJP is also strongly against corrupt practices in the selling of citizenship of which we are experiencing a tsunami. Find out more on their website. Everyone will likely wonder whether the Caretaker Finance Minister, who did plead guilty to the conspiracy which put the others in gaol, or his advisers, might have been involved, especially since each recipient/conspirator in the bribery case received vt4,452,023. It is too large a sum to be blamed on a clerical error. However, there has been no announcement of any investigation into the illegal gratuity issue by Finance. One also wonders why not? in that regard. The other conspiracy case, the Pipite Purported Pardons, will be heard on the second of February. The Magistrate’s Court did meet yesterday afternoon, despite the earlier unofficial announced date of tomorrow, to hear the Preliminary Inquiry of the Public Prosecutor. Prosecutions submitted 42 witness statements, three items of exhibit and various documents, Post tells us. Former MPs Marcellino Pipite, Silas Yatan, Arnold Prasad, Thomas Laken, John Amos, Paul Telukluk, Sebastien Harry, Tony Wright, Tony Nari, Jean-Yves Chabod and Jonas James were all charged with conspiracy to defeat the course of justice, a crime under the Penal Code (section 79a). The conspiracy was planned to have the Acting President Pipite pardon himself and 13 others involved in the bribery case immediately before the return of the substantive President from overseas. The group is headed by a former Prime Minister of the Bahamas, Hubert Ingraham. They arrive today from Australia, Guyana, Fiji and Uganda. They remain until 5 days after the elections, reports the Daily Post. A former ombudsman, an MP, an editor, an election supervisor and a gender equity expert are included in their ranks. The court case being brought by a former chargé d’affaires in Beijing, Willie Toama, will not delay the snap poll. Toama’s name was not included in the official list of candidates. This video explains why traditional architecture is preferable as a cheap, cyclone-resistant and sustainable form of housing. Cyclone Pam was a Category 5 cyclone, the highest rating on both the Saffir-Simpson and the Australian cyclone scales. Sustained winds were measured at over 270km/hour, and gusts were recorded at 320km/hour, but were possibly higher than this over Erromango and Tanna. Meteorologists are still debating whether Cyclone Pam is the first Category 6 cyclone ever recorded. Photo: Vanuatu Department of Women’s Affairs < Read Part 1: ‘Ghostbusters: it’s time to deal with Vanuatu’s phantom voters’   VANUATU’S NATIONAL ELECTIONS give citizens the opportunity to shape the nation’s future through their choice of political representation. Electoral boundaries and the total number of constituencies have shifted over the years in response to demographic changes. Recent media reports have suggested that electorates will be again be modified sometime before 2020. Today, there are 52 seats in the national parliament, with MPs drawn from most of Vanuatu’s different islands. However, this seeming diversity masks the lack of representation of different demographic groupings within Parliament: women, young people, people with disability, religious minorities and other groups that are not part of the mostly male political elite are effectively excluded. The omission of a significant proportion of the population disadvantages Vanuatu’s national development, because their contributions and needs are left out of the political debate. Residents of the affected parts of Tafea province are advised to take shelter from the cyclone immediately. Overnight, heavy rain and flooding in low-lying coastal areas and riverbanks are expected in the affected areas, along with very rough to phenomenal seas with heavy swells. Winds at the centre are currently at 175km/hr and intensifying. Damaging strong to gale force 65–75km/hr winds will continue to affect Aneityum, Futuna and south Tanna overnight. The eye of the cyclone is not expected to pass over any islands in Vanuatu at this time. The cyclone is currently moving away from Vanuatu in a southwesterly direction. This is the cyclone which passed near certain islands of Fiji this week and which, for us, is not maintaining a sufficiently southerly course. Latest information is always available from http://www.meteo,gov.vu, together with satellite photography of the area. There is not a lot of news today other than that which involves candidates in one way or another. There are well-known names of those who have turned to politics, in some cases for yet another try. This site will not be concerned with such stories, simply publishing the names of the second official declaration of candidacy when it is available electronically, which declaration has not yet occurred. Today's Independent gives details of the already known and named 7 women candidates. In other news, Daily Post has come out strongly against domestic violence with news of the death of a woman known to many attributed to such a cause and with a serious piece by Mark Bebe, DG Justice Ministry - "Violence against women must be eradicated." Radio Vanuatu News this morning began with a long report concerning the dispute between Airports Vanuatu Limited and AVL staff, members of the Vanuatu Workers Union, and the handing over of a report by the Arbitration Board to the Caretaker Minister yesterday. The matter undoubtedly remains with the Arbitration Board and, likely, the next government for resolution. Daily Post questions inaction over the convictions for reckless and careless driving of the Police Commissioner, John Taleo. He was convicted on 15 December but the Police Service Commission has not taken any decision in the matter the paper reports. The Independent leads with the story of a "major seabed lease scam" over the Fatumauru Bay seafront from Anchor Inn to Chantilly's. Delegates from Samoa and the Cook Islands have agreed to participate. Conflicting times have been given in the media for the announcement of the second declaration of candidates. This will be either this evening or tomorrow. For some reason it has been seen to be necessary to have printed a total of 4 million ballot papers for a record total of 28 parties. Many alleged parties have never been heard of before, or were quickly forgotten after their last fleeting appearance. The same goes for individual candidates, there being 41 independents, at least at the time of writing, there being no knowledge of what the second declaration might find. "Ghostbusters: it’s time to deal with Vanuatu’s phantom voters" is the first in a series of three papers concerning Vanuatu's election practices and was sent to you this morning. Not only is a denial of the democratic right to vote, it highlights the inaccuracy of Vanuatu’s electoral roll. In Vanuatu’s 2012 General Election, an estimated 55,000 dead people were included on the electoral roll as eligible voters, about 140% more voters than official census data says there should be. This article suggests a simple and cost-effective way of ensuring the integrity of Vanuatu’s electoral roll so these ‘phantom voters’ don’t come back to haunt us. Voting takes place on 22 January. 72 hours are given for those whose applications were un-acceptable in the first declaration to re-submit their candidacy forms. Kilion Taleo is Chairman of the Electoral Commission and presided over the first declaration. The Vanuatu Labour Party has said it will be starting its campaign on Sunday when the names of its two candidates have been revealed in the second declaration on Saturday. The party expressed displeasure over the working of the Commission.
