This will not now occur. Judge Aru has declared that all parties concerned have consented to the following orders: 1. The Judgement issued on 24 June 2015 be stayed until 4.00 pm on Thursday 2 July. 2. The First Respondent [Speaker Pipite] shall prosecute his appeal and have it determined by Thursday 2 July 2015 before 4.00 pm. 3. In the event that the appeal is not determined by the date and time set out in paragraph 2 above, the speaker shall convene Parliament at 4.00 pm on Thursday 2 July 2015 to debate the motion of no confidence against the Prime Minister Hon. Sato Kilman Livtunvanu. 4. Parties to bear their own costs. Parliament Speaker Pipite's appeal against the Supreme Court's judgement that he illegally closed Parliament last time was granted a "stay" order late yesterday of just two days. Pipite's legal team has until 12 noon Thursday July 2 to try to put forward a case. It was agreed yesterday evening, by consent of the lawyers of both sides, that if the appeal has not been determined by 12 noon on Thursday, the Parliament sitting must be re-instated by the Speaker by 4 pm Thursday 2 July. Daily Post has the late arriving story on page 3. Radio Vanuatu News this morning did not mention the case. Air Vanuatu engineering / technical staff have petitioned against the Manager of the Engineering division, Daily Post reports today. He, Jim Samson, is alleged to have had the maintenance manual amended at the expense of Air Vanuatu to suit his qualifications. The Civil Aviation Authority has also failed to approve the appointment of Samson who is said to be appealing. Daily Post also points out the possibility of of a tropical disturbance developing into a cyclone in the next 24 to 48 hours. There is said to be a moderate possibility of this happening. The low is 420 nautical miles due north of San Cristobal in the Solomons. Daily Post highlights the advances made in tourism in Torba Province one year after the introduction of the Australian funded TVET Centre at Vanualava. Seven island bungalow projects at Motalava and Rah have begun marketing. And Thompson Marango of Post, in Nadi, advises of the opening of Agritourism Week for the Pacific at Sofitel, Denaru. Attended by Pacific farmers, chefs, government officials and representatives of all tourism and agriculture sectors, the European Union assisted event promotes a push to include more local produce in Pacific hotels and restaurants. It is possible this will be "in conference" rather than in open court, Justice Aru having already declared the illegality of the closing. So your one-man no-cost news agency, the Digest, has a little more time for further news of this and other related matters at this time. Parliament is to sit tomorrow at 4 pm to hear the Opposition motion against PM Sato Kilman's Government as Daily Post tells us today. Radio Vanuatu persisted in reporting the claims of the Kilman Government, that it has the support of 29 MPs. Opposition Leader Edward Natapei, in Vila Times, says the Government is trying to buy time in the seeking of an appeal against Justice Aru's Supreme Court decision. "If the Government has the numbers they should let it [the motion] go and defeat it tomorrow in Parliament," he reasonably observes. Natapei also observes that the ousting of the Natuman-led government is clearly linked to the West Papua issue and the Kilman "neutral" stance as regards West Papua. Businessman Tom Bayer is named in Vila Times today as the businessman faced with complicity charges in the allegations of bribery of MPs brought by the Public Prosecutor. His name was mentioned last week at the first hearing. Bayer is held on bail, but his lawyer, who had only received court documents two days earlier, will be absent until 14 July when the Preliminary Inquiry will now be discussed in the Magistrates' Court. Vila Times gives further details of the way in which the sum of VT 35 million was obtained from Chinese business interests, and from the sale of the land owned by Marie Louise Carcasses in Rentabao. The charges were not detailed in the news report, but were linked to a statement that civil servants have the right to purchase land and own permanent premises when they leave the public service. Radio News at mid-day made it clear that both PNG and Fiji voted for the associate membership of Indonesia to the Melanesian Spearhead Group, even though the ULMWP achieved only observer status. Pastor Alan Nafuki of the West Papua Freedom Movement and the VCC wistfully accepted the Indonesian achievement, but pointed out that ULMWP would have another chance to improve its position next year. The Independent's front page today has First Deputy Speaker Samson Samsen and MP Kalfau Moli remaining as state witnesses in the bribery case. The Independent could not manage to obtain a comment from Internal Affairs Minister Hosea Neveu. All three MPs have declared themselves Prosecutions witnesses. The motion of no confidence will be heard on Tuesday by court order. He is preparing a paper for the Council of Ministers. He says repeal is necessary to ensure economic development will be fair for the custom land owner and developers. This statement is made despite the Land Law Reform Act following recommendations of various summits of land owners over many years. Radio Vanuatu News today reports the ULMWP being granted full observer status in the MSG in yesterday's MSG leaders' meeting in Honiara. Indonesia was also granted associate membership of the MSG. Clarification is expected with a statement to be released later. Radio Vanuatu News says it is the first time Vanuatu has a national agriculture policy. This was launched by the Ministry and DPM Moana Carcasses Kalosil today before a large audience when Principal Agriculture Officer Antoine Ravou stated the 15-year policy has arrived at the right time to direct stake-holders as regards their roles and responsibilities. Radio News gave no further details of any changes to existing agriculture policy, but "now there is a roadmap." Daily Post has new Public Utilities Minister Tony Nari warning Public Works heads they will be disciplined if they are involved in "corrupt deals". Minister Christophe Emelee claims Torba PWD road maintenance staff "only play cards during working days." The same sentiment was shared by MPs Don Ken and Jerome Ludvaune (Malekula), Robert Bohn (Epi), and Jonas James (Paama). "Shady deals" with private companies were also mentioned. The Preliminary Inquiry for this bribery is now delayed because of evidence given by named identities from the business community who now require legal representation. The Daily Post this morning points out Justice Aru's declaration that the sitting of Parliament was still open when new Speaker Pipite decided to close it, which action was unlawful. Pipite was quoted on Radio Vanuatu News this morning as saying he will appeal. The granting of such an appeal is unlikely in view of the many decisions concerning motions in the past from which Justice Aru drew in making his own decision. Post also points out that the PM is not attending the MSG Summit in Honiara, largely concerned with West Papua (over which personal stand he lost his foreign minister-ship through not playing ball with then-PM Natuman and the then-Council of Ministers). Daily Post Tuesday has Vanuatu Christian Council Chairman Bishop James Ligo highlighting the importance of West Papua in its rightful place in the MSG. Wednesday the Malvatumauri President Chief Senimao Tirsupe clearly states it would be "dishonest for Vanuatu not to support the West Papua application." Vila Times which comes out on Mondays has a front-page editorial covering unprincipled leadership and vote buying of leadership positions for MPs for millions of vatu. It should also not be missed for a coverage of the re-activation of the 2007 Kava Act for which the previous minister (David Tosul) was responsible.This provides for protection against the worst effects of "two-day" kava for all concerned, from drug manufacturers to those pleased to have a dose of this country's highly valued euphoric. The National Disaster Management Officer- NDMO - is reviewing the lessons learned from cyclone Pam. A release from the NDMO says it will "continue to strengthen its communications not just to our communities but also from them." The Digest particularly insists that the communicating role of the national broadcaster in promulgating warnings will not be diminished and shortwave transmission of such warnings should continue to be of the utmost importance. Yesterday's Daily Post has deported lawyer Robert Herd back in the country. He was deported last September for alleged interference in local politics. As well as the news of the resumption of Parliament next Tuesday, today's Daily Post has the VAT exemption on building materials ended last Friday. And a good news on which to end today: TVET is to commence its training activities at its fourth centre in Tafea in the very near future following a soft launch with rehabilitation works on Tanna. However, the lawyer acting for a newly indicated local businessman defendant in the matter was able to obtain a delay owing to his imminent absence and it was also observed that the Appeal Court will be sitting in just a few weeks. As such it was also arranged that the Magistrates' Court will again sit on 14 July to decide on a new definitive date for the preliminary enquiry. This is the meeting to decide upon the issue of West Papuan observer status to the MSG. We are to be told the Government's stand before the issue is discussed in Honiara, Post reports. Vanuatu has previously championed the West Papuan cause, reconciling the freedom movements here last year as the United Liberation Movement of West Papua (ULMWP) under an initiative of the Malvatumauri and former PM Natuman. However, the new Prime Minister had not seen the ULMWP Ambassador to the MSG Secretariat, Amatus Douw, before the Ambassador proceeded to Honiara yesterday. UNDP and the Vanuatu Government are working on a VT 800 million climate change project for rural communities. called Adaptation to Climate Change on the Coastal Zone of Vanuatu (V-CAP). The resilience of coastal zones to climate change in order to sustain food production and livelihoods will firstly be studied in relation to the areas most affected by cyclone Pam, Epi and all Tafea islands, Post announces. Tomorrow, Tuesday, will determine whether the 16 MPs in the bribery case will stand trial on 7 July. The Independent at the weekend points out the judiciary will treat the matter as any other criminal case. The Independent reminds everyone the bribery case is on Tuesday and the constitutional case is listed for Monday. Tuesday will determine whether the 16 MPs in the bribery case will stand trial on 7 July. The Independent points out the judiciary will treat the matter as any other criminal case. In addition, says the Indy "the Judiciary will not entertain any order issued by the current government until the matter is settled in court." A Daily Post editorial calls on politicians to set aside their differences and put the national interest first as its nationals require. Daily Post leads with the private sector calling for a repeal of the Industrial Development Act which came into being to promote private sector led development but lacked completion of discussions with the Chamber of Commerce (VCCI) and Manufacturers' Association (VMEA). Amendments might have been possible had the short-lived sitting of Parliament not been closed by the new Speaker. A 16 kg petition from 150,000 West Papuans, organised by the United Liberation Movement for West Papua (ULMWP), is in Port Vila awaiting the approval of PM Kilman, not known for strong secession views on behalf of West Papua. It goes to the MSG Leaders' Summit in Honiara this coming week and concerns West Papua's application for membership of the MSG. There was not a lot of other news requiring the same attention this week. A police officer has been charged with fraud in relation to the fake road tax stickers, driver's licences, government receipts and other documents. He will be sentenced on July 3. Willy Missack, 25, will be presented with a Young Leaders Award by the Queen on Monday for his work in creating a vital, sustainable water supply for his community. He will receive his award at Buckingham Palace. He is one of 60 Commonwealth young people to receive such an award. The Vanuatu Christian Council has launched a nursery project on Murray Hostel / VCC land, opposite the Tourism School. They have plot of seedlings from seed donated after the cyclone and they are currently offering free Chinese cabbage and round cabbage seedlings to those who have prepared their home garden plots. Australian employers are here advising ni-Vanuatu potential farm workers of their requirements of Melanesian labour from Vanuatu. In Daily Post today they point out that team dynamics are sometimes hard to find in young men from different island communities. The Transparency page today in Daily Post has an excellent article on how the gap continues to widen between the values that achieved Vanuatu's Independence and those which dominate politics today. Transparency also has a history of no confidence motions against prime ministers since 1980. In case you missed the earlier item today on the Constitutional case, here it is again ... The Supreme Court has agreed with the Opposition that it has a case which must be answered and Constitutional Case No. 2 of 2015 will be heard at 2 pm on Monday. Daily Post reports this today. VBTC News at 6 am did not say anything about the matter. Justice Dudley Aru yesterday afternoon heard the application of the Opposition bloc represented by Ronald Warsal & Co. The Applicants are seeking a court declaration that new Speaker Marcellino Pipite was in error in closing the sitting of the First Ordinary Session of Parliament in breach of their rights under Articles 6 (1), (2), 43 (2) and 53 (1), (2) of the Constitution. They are also seeking an order that Parliament be reconvened as soon as possible to hear the motion of MPs Natpei and Lini of no confidence in new PM Kilman. Pipite is represented by Robin Kapapa and the Republic by the State Law Office. The Speaker is to file responses by 1.30 pm today. The Applicants have until 4.30 pm today to further respond and final submissions by Speaker Pipite will be needed by 11.30 am on Monday for the 2 pm hearing of the Supreme Court. Marcellino Pipite, has just become the new Speaker. He was elected un-opposed. Parliament took the vote after the previous Speaker Philip Boedoro was voted out. 28 MPs voted for Boedoro's being removed, it was said in the Radio Vanuatu News at 6 pm, and 23 voted against. Parliament also voted out the Second, Third and Fourth Deputy Speakers. The First Ordinary Session of Parliament was also closed at that time. Indeed it does, as do many bus drivers in Port Vila. They may well be considered representative of the whole electorate. The general public is aware that a government has been created comprising seven ministers along with nine others charged with bribery and offences under the Leadership Code. The Kilman Government argues that because the Appeal Court enabled their suspension from Parliament to be lifted, the motion (of the Natuman Government) presently before the Parliament is invalid. The Kilman Government plans to "discipline" former PM Natuman, DPM Lini and Speaker Boedoro. Meanwhile the new Minister of Lands, Paul Telukluk, has "thrown out" the Land Rent Review of the former government in 2014 saying that the increase in land rents is unconstitutional and against the meaning of independence. This is, allegedly, because ni-Vanuatu cannot afford the price of land in towns, Radio Vanuatu News reported. That said, many ni-Vanuatu do live and work in the towns. The new Minister of Internal Affairs, Hosea Nevu, has announced a comprehensive review and audit of all citizenship programmes. In just three days of taking office he has hired "a respected external company to government undertaking this review to ensure there is no political interference or bias," he tells Daily Post. They still do. But to bring up some other matters, here is the rest of the news ... Vila Times, which comes out on Mondays, last week gave the reasons for the Natuman Government dropping its former Foreign Minister Kilman. He had by-passed the Council of Ministers in various decisions he had taken, especially in the appointment of certain Asian nationals as Vanuatu ambassadors and diplomats, and interfering with foreign policy which upset European Union countries assisting Vanuatu, especially after cyclone Pam, the paper said. Radio Vanuatu News this morning had the new Prime Minister Sato Kilman calling on MPs of the new Government side to continue to give their support to the new Government whether or not they were called on to be ministers, there being only thirteen ministries. He made the call when appointing his cabinet Thursday night. This week the real estate industry met former Lands Minister Regenvanu in a meeting chaired by the Vanuatu Chamber of Commerce and Industry, VCCI. This was intended to hear complaints from the industry. Forfeiture of leases under new legislation became an important item on the agenda. Leases involving development must be forfeited if they are not developed within five years. Existing leases for development need to be developed within one year Daily Post reported Thursday. The meeting learned of new equipment and practices for boundary marking, "improvements" to the road to Devil's Point, and that there will soon be a law against sand mining. Vanuatu broadcasters and media personnel have been assisted by PACMAS and Geo-Hazards in Vanuatu to prepare plans which will assist resilience to climate change and encourage preparedness for disaster conditions, such as with cyclone Pam. Eight countries attended the training here Vila Times reported. The environment was indeed recognized during Environment Week and Environment Day. An agreement was signed with the South Pacific Regional Environment Plan - SPREP- which will see Vanuatu host an adaptation to climate change programme here. Daily Post today has Air Vanuatu apologizing for the loss of seats from Sola for a number of passengers. The matter came about because of a huge (600 kilos) shipment of coconut crabs and other cargo from the Torres. This caused further delays for passengers in Santo. A sub-division plan for part of Lenakel, Tanna, announced this week, still needs the approval of custom owners. A Magistrates' Court decision in 2012 is being appealed by 7 claimants other than he who made the announcement. The Latter-Day Saints have provided some 312 new wheelchairs for the Vanuatu Society for Disabled People (VSDP). In addition there were parts and other equipment in the container and LDS gave three days of training. The bribery case against 19 MPs, now all on the government side, it is believed, can only be constitutionally adjourned whilst Parliament is sitting, as Thompson Marango points out in Daily Post today. Of the new Kilman Government there are seven of Cabinet rank who face bribery charges. The possibility of choosing persons as ministers who might soon have charges against the Leadership Code or criminal records rather suggests personal character was not an issue in determining the capability and suitability of would-be ministers when the new government was formed. As already reported yesterday, the former government leaders MPs Natapei and Lini and others have deposited a motion of no confidence against the Kilman led government. Questions will continue to be asked until the bribery cases reach court and adjudication. The veteran politician had not detailed the offences committed by his former minister when his termination was announced. The most blatant Kilman move against the unity of his colleagues was in his decisions as regards the West Papua struggle for independence from Indonesia, Natuman explains, answering Kilman. Vanuatu was mis-represented by Kilman at the 60th Asian - African Conference. Kilman had also tried to lobby for a new ambassador for Vanuatu in Jakarta and was too closely connected to the recently arrested Kevin Lai in Thailand. For his part Kilman is seeking legal advice to sue Vila Times over a recent article not yet seen by this Digest concerning alleged "media fabrication." The Digest will attempt to cover this. Post also reveals that former Justice Minister Alfred Carlot feels he was terminated for not agreeing to take on the foreign minister post, and that re-shuffling means more instability. PM Natuman may now reveal more in Parliament tomorrow. However, it is certain he will emphasize the need for team work and employment of the most loyal and capable as ministers of government. The motion is apparently to be heard at 4 pm tomorrrow. Daily Post carries the news of the passing of this heroic woman leader in the judiciary. Her importance was underscored by the Head of State offering a minute's silence in honour of her by name, and other leaders recently, before even giving his speech to open Parliament this morning. The Post news is accompanied by a lovely photograph on page 1 of the highly respected role model. Daily Post also has the new ministers removing their names from the motion of no confidence in the government. Police investigations continue into the cases of the Opposition Members charged with offences against the Leadership Code (including bribery). The first action in this matter, after the alleged offences being allegedly committed and MPs suspended, was the appeal to the courts of those implicated to have parliamentary suspensions lifted. They were. However, the charges are still being investigated by the Police. The Ordinary sitting of Parliament continues this morning. Nagriamel spokesman Jeff Joel Patunvanu insists Nagriamel is remaining strongly supportive of Government. "The Nagriamel Movement is committed to working with the government to achieve development goals for social and economic progress and benefit for the people of Vanuatu," said Patunvanu to Post. Tourism gets first mention where Services are concerned and the Productive sector comes in next to emphasize fisheries, agriculture, forestry and livestock, occupying the majority of the population. The outlook for 2016, especially regarding agriculture in Shefa and Tafea, has been severely affected by Pam, the statement acknowledges. Reduction of foreign exchange earnings means foreign reserves will continue much lower than predicted. The current account is already contracting this year, of course, and VAT exemptions have naturally highlighted this. It is interesting to note, however, that the Government will continue to counter mal-administrative practices such as tax evasion or avoidance by working towards establishing a competent authority. OECD and Global Forum tax information exchange agreements will guide the Government. The Public Finance and Economic Management Act (CAP244) will guide the Government regarding policies in 2016. It's good to have such an unequivocal policy statement. Daily Post begins this week quite rightly challenging the VPIEF to ensure it is not another Ponzi scheme, of which we have seen too many in Vanuatu. Membership fees being used to buy land and vehicles when leaders have the support of thirty or forty thousand people is fine, but does not necessarily make money for the investors. Post also has the Chamber of Commerce meeting with Lands Minister Regenvanu this coming week to discuss difficulties in obtaining leases. This will be prior to the VCCI' annual general meeting, also this coming week. Opposition Leader Carcasses is one of nineteen involved in the bribery allegations under investigation. Daily Post this morning began with the appointment of two new ministers, Kalvau Moli replacing Sato Kilman at Foreign Affairs, and Hosea Neveu replacing Alfred Carlot at Justice. MP Sato Kilman yesterday joined the Carcasses bloc, together with MPs Dunstan Hilton and Isaac Hamariliu. However, MP and Minister George Wells of their party remained with the Natuman Government.
